OVERVIEW
This website is operated by Daily Death. Throughout the site, “we,” “us,” and “our” refer to Daily Death. By visiting dailydeath.com or purchasing from us, you agree to these Terms of Service and the policies referenced below. If you do not agree, please do not use the site.
1. ELIGIBILITY AND ACCOUNTS
You must be at least the age of majority in your state of residence to make a purchase. You agree to provide current, complete, and accurate account, billing, and shipping information and to keep any account credentials secure.
2. PRODUCTS
We make reasonable efforts to display product colors, details, and sizing accurately, but appearance may vary by device. Many products are made to order and fulfilled by third-party production partners. We may modify or discontinue products, limit quantities, or decline an order where permitted by law.
3. ORDERS AND PAYMENT
Submitting an order is an offer to purchase. An order is accepted after payment is authorized and we confirm the order. Prices and promotions may change without notice. Taxes and shipping charges are shown at checkout where applicable. We may correct pricing or listing errors and may cancel affected orders with a refund.
4. ORDER CHANGES AND CANCELLATIONS
Made-to-order products can enter production shortly after purchase. Contact us immediately if you need a change or cancellation. We will try to help if production has not started, but changes and cancellations are not guaranteed.
5. SHIPPING AND DELIVERY
Processing and delivery dates are estimates and are not guaranteed. Orders may arrive in separate packages when fulfilled by different production partners. Carrier delays and events outside our reasonable control may affect delivery. See our Shipping Policy for current details.
6. RETURNS AND REFUNDS
Purchases are subject to our Return and Refund Policy. All sales are final except for approved claims involving damaged, defective, or incorrect items and any rights required by applicable law.
7. INTELLECTUAL PROPERTY
The Daily Death name, logos, artwork, designs, photographs, text, graphics, and site content are owned by or licensed to Daily Death and are protected by applicable intellectual property laws. You may use the site only for personal, non-commercial purposes. No content may be copied, reproduced, distributed, modified, sold, or exploited without prior written permission.
8. ACCEPTABLE USE
You may not use the site or services for unlawful, fraudulent, abusive, or harmful purposes; interfere with site security or operation; introduce malicious code; scrape or harvest customer information; impersonate another person; or infringe the rights of Daily Death or any third party.
9. THIRD-PARTY SERVICES
Our store is hosted by Shopify and may use third-party payment, fulfillment, analytics, and social-commerce services. Those services may be governed by their own terms and privacy policies. Daily Death is the seller for purchases made through this store; Shopify is not responsible for the products sold by us.
10. PRIVACY
Our handling of personal information is described in our Privacy Policy. By using the services, you acknowledge that information may be processed by Shopify and the service providers necessary to operate the store.
11. DISCLAIMER AND LIMITATION OF LIABILITY
To the fullest extent permitted by law, the site and services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free access. Daily Death will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the site or products. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.
12. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Daily Death and its service providers from third-party claims arising from your unlawful use of the services or your material breach of these Terms.
13. SEVERABILITY AND WAIVER
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of that provision.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise.
15. CHANGES
We may update these Terms by posting a revised version on this page. Material changes take effect as required by applicable law. Continued use after an update constitutes acceptance of the revised Terms.
